The Defamation Bill - an update for website operators

The decision of the Court of Appeal in Mitchell v News Group Newspapers Limited

The court's tough stance on compliance with rules and deadlines has had the harsh edges removed, but is still here to stay.  Anyone considering litigation must remember that the issue of proceedings is not the end, but just the beginning of the process.  Parties will have to comply with numerous deadlines, which may require substantial amounts of information and documents to be provided to their solicitors in short periods of time.  The penalties for lateness are potentially severe.  Read more

Right to be forgotten

Irfan recently spent a day at the Leicester County Court, where he not only succeeded in obtaining a summary eviction order against squatters on a commercial property, but managed to give the judge a quick lesson in the correct form of court order to be used for the occasion.

Naturally modest Irfan downplayed his skill in court, saying "persuading the judge to make the eviction order was not difficult, because the application had been prepared thoroughly beforehand and the evidence was clear on paper".

What Irfan did not add was that even prior to commencing his training contract with EMW, he had successfully brought a claim in the Employment Tribunal on behalf of a primary school teacher wrongly accused of and unfairly dismissed for striking a child. The stakes were high as the matter was of critical importance for the reputation of his client, but over the course of a two day hearing Irfan coolly despatched an experienced barrister who had been sent by the employer and local authority to fight their corner. Irfan's client's reputation was vindicated and damages were awarded in her favour.

At the time of writing, Irfan is heading to Glasgow for a five day hearing in the Employment Tribunal where he will be deploying his formidable courtroom skills.
