In Tindall Cobham 1 Ltd and others v Adda Hotels and others the Court of Appeal decided in favour of the tenants and ruled that a tenant's guarantor cannot be obliged to become the direct guarantor of the assignee on the transfer of a lease, even if it is an intra-group transfer, because it goes against the aim of the relevant statute.  Read more

Ensuring tenant fit out projects are insured

When a tenant decides to carry out fit out works, the usual position is that the tenant fit out works are taking place either after practical completion of the main construction works to the property or in a property which has been completed for some time. There are 3 main insurances which need to be put in place when construction works are to be carried out in an existing building.
